What this means

  • Your individual claim is generated from the information you provide and is not individually reviewed by a lawyer.
  • The free check shows the conditions the Act sets next to your answers. It does not determine whether you are entitled to make a claim, and it is not advice about your situation. The decision whether to proceed is yours.
  • All other content on CLAIMD (the FAQ, the countdown, the "what happens next" lines and the emails) is general information about the NSW Act. It is not advice about your work, your Construction Contract or the Respondent.
  • The dates CLAIMD shows are calculated from the dates you enter. An incorrect date will produce an incorrect result. Check the dates against your Construction Contract.

What CLAIMD does not do

  • This site is to be used for information purposes only.
  • This site does not determine whether the user's contract is a "construction contract".
  • This site does not determine whether a payment claim may be served for a particular month.
  • This site does not determine whether the claimant is entitled to the amount claimed.
  • This site does not guarantee that an adjudicator or court will accept the claim.
  • The user remains responsible for verifying all information.
  • The user decides whether and when to serve the claim.
  • The user is responsible for compliance with statutory time limits and service requirements.

No guarantee of payment

Submitting a Payment Claim does not guarantee payment. It starts a process under the Act, with time limits the Respondent must meet. Neither the Act nor CLAIMD guarantees that you will be paid.

When to obtain legal advice

Consult a construction lawyer if the Respondent disputes your claim, if a deadline is close, if you are considering adjudication, court proceedings or suspending work, or if anything about your situation is unclear. If the Respondent is in liquidation or administration, CLAIMD cannot assist, and you should contact the liquidator or administrator.

NSW only

CLAIMD is designed for construction work and related goods and services in New South Wales, under the Building and Construction Industry Security of Payment Act 1999 (NSW).
