Privacy policy

CLAIMD is operated by CLAIMDAU Pty Ltd, ABN 34 701 711 391 ("CLAIMD", "we", "us"). This policy covers claimd.au, app.claimd.au, our emails and text messages, and any information you send us. In this policy, the Respondent is the party to the Construction Contract who is responsible for paying you and to whom your Payment Claim is served: for example, a head contractor where you are a subcontractor. It is not always a builder.

Version 1, 13 October 2026.

CLAIMDAU Pty Ltd, ABN 34 701 711 391. Contact: support@claimd.au

Summary

  • We collect the information we need to assist you in preparing your claim, and little else.
  • Your information is stored in Australia, in Sydney, and is encrypted.
  • We never sell your information. We never send your details to the Respondent unless you serve the claim (or select send, if that feature is switched on).
  • Stripe processes payments and may process your payment details overseas. This is the main way information leaves Australia.
  • You can download the information we hold about you, correct anything that is inaccurate, and ask us to delete your account. We are required to keep some records.

What we collect

We ask only for information the claim, the account or the law requires. We do not ask for identity documents or bank details, and you should not include them in a claim.

When you use the free check: your answers (no names and no contact details), a one-way hash of your IP address, and the time. When you open an account: your email address, mobile number and name. When you prepare a claim: about your business (legal name, ABN, address, signer, email, mobile and GST status); about the Respondent (legal name, ABN, address, mobile, the email address you intend to serve to and your reason for choosing it); about the work (site, project name, description, amounts, variations, amounts paid, contract and work dates). When you pay: Stripe gives us the amount, the confirmation and its reference numbers; we never see your card number. When you serve or record service: the date, the method and the address used, and anything you forward to your claim's proof address. When you contact us: your name, contact details and message. On each visit: security records and an audit trail of each action on each claim.

Information about the Respondent. Most Respondents are companies, but some are sole traders, so some of this information may be personal information about an individual who did not provide it to us directly. We use it only to assist you in preparing and serving your claim.

You can use the free check without identifying yourself. You cannot prepare a claim anonymously, because the Act requires the claim to identify the claimant.

How we use it

To run the check; to assist you in preparing, storing and delivering your claim; to calculate dates and send you reminders; to take payment and issue tax invoices; to sign you in; to respond to your messages; to keep CLAIMD secure; to keep the records the law requires; and, only if you ticked the box, to send you news about CLAIMD. We do not use your information to train artificial intelligence, and CLAIMD's check, claim and countdown do not use artificial intelligence.

Decisions made by the computer

The free check runs on fixed rules written in advance. No person reviews each check as it happens, and no AI is used. It uses only your answers to its questions. Some answers stop the check, for example work outside NSW, a business in liquidation or administration, or work for a homeowner on the home they live in where the contract was made before 1 March 2021 or the required licence and home warranty insurance are not held; other answers show a warning. When you get through, you see the Act's conditions next to your answers and decide for yourself: the check never tells you that you're eligible, never tells you a claim will succeed, and never puts a dollar figure on it. The claim form and the countdown work out dates: the earliest and latest days you can serve, the deadlines after you serve, which reminders you get and when, and the status shown on your claim. They use the dates, contract details and chain position you enter, the date you record for service and anything you log afterwards. Every date on your review screen shows how it was worked out. If you think the computer got something wrong, email support@claimd.au and a person will look at it.

Who we share it with

We never sell personal information. We share it only with:

  • The Respondent, and only the claim itself: when you serve it yourself, or when you select send (if that feature is switched on). We do not provide any other information about you to the Respondent.
  • Service providers that operate CLAIMD for us, only to the extent they need it: Amazon Web Services (hosting, database, file storage and email, in the Sydney region) and Stripe (payments).
  • Our software developer, who builds and maintains CLAIMD under contract for us, for support and to correct faults.
  • CLAIMD's own team, who can view claims to assist you and to resolve problems. Every access to a claim is logged.
  • Anyone you ask us to send it to, such as your lawyer or an adjudicator.
  • Anyone to whom the law requires us to provide it.

Address lookup is provided by Google Maps Platform. When you type in an address field of the claim form, only what you type in that field is sent to Google so it can suggest addresses. Nothing else about you or your claim goes with it. We do not keep what you typed, only the address you choose, which becomes part of your claim.

Where it is stored and for how long

All information we store is stored in Australia (AWS, Sydney), including backups. Stripe, which processes payments, may process data in the United States and other countries. Claim documents and proof of service are kept for 7 years. They are never edited: a correction makes a new version and the earlier one is kept. Other records are deleted automatically when their period ends.

Access, correction and complaints

Access. "Download my information" in your account gives you your claims, documents, invoices, consents and email records. You can also email us.

Correction. You can update your details in your account, or email us. A Payment Claim that has been served cannot be changed, because it is a record of what the Respondent received. An incorrect claim that has been served generally cannot be re-sent in amended form unless both you and the Respondent agree. If a change needs to reach the Respondent, the new version is not sent automatically: you must serve it on the Respondent yourself. Usually the better course is to start a new Payment Claim for the next named month. The served version is kept on file unchanged.

Deletion. If you ask us to close your account, we delete your contact details and any unfinished claims. Paid claims, their documents, invoices and proof of service are kept for 7 years.

We respond to access and correction requests within 30 days, free of charge. Complaints: email support@claimd.au first. If you are not satisfied, you can complain to the Office of the Australian Information Commissioner (oaic.gov.au, 1300 363 992).
